Common Injuries – How Much Might I Get?
Quite understandably this is one of the first questions we get asked when we are discussing a case with a new client. You want to know if it is worth your while financially pursuing a legal case. Until we investigate your case properly it is very difficult indeed to give you an accurate indication of your possible award. With that in mind the following is for information purposes only.
How much you will get depends upon a number of matters including but not restricted to:-
Your age at the time of the injury
The severity of the injuries and the recovery time
Any loss of earnings. This in itself can be a huge part of the claim, sometimes dwarfing the damages recovered for the injury itself.
Loss of pension
The cost of care/rehabilitation
Every year the Judicial College publish guidelines which provide an indication of how much you may be awarded for common injuries. We must stress that these are guidelines only and cannot be taken as fact in terms of how much you may receive. The figures below, taken from the 15th edition of the guidelines, are restricted to what we refer to as general damages only. That is to say that they are indicative of how much you may receive for the injury alone and do not take into account special damages such as loss of earning. The figures provided relate to the most severe injuries:-
Elbow injuries – up to £51, 460
Back injuries – up to £151, 070
Pelvic injuries – up to £122, 860
Wrist injuries – up to £56,180
Arm injuries – up to £122, 860
Brain injuries – up to £379, 100
Facial fractures – up to £34, 480
Facial scarring – up to £91, 350
Leg/foot injuries – up to £264, 650
As mentioned above, these awards are for the most severe of injuries. General damages awards will of course decrease in less severe cases.
